Terms governing the use of CCI Social Monitoring and Clinic Competitive Intelligence (CCI).
CCI Social Monitoring is a feature of Clinic Competitive Intelligence (CCI), a competitive-intelligence platform provided by Fifth Element Agency Co., Ltd. CCI helps aesthetic-clinic operators monitor publicly available competitor business content, detect meaningful change, and convert market movement into actionable intelligence.
By accessing or using CCI Social Monitoring, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
You agree to use CCI Social Monitoring only for lawful business-intelligence purposes in compliance with applicable laws, regulations, and third-party platform terms. You will not attempt to reverse-engineer, disrupt, or overload the service or its integrations.
CCI Social Monitoring is designed to access publicly available data through official Meta APIs. The nature of public-data access means that data availability depends on the third-party platform's settings, permissions, and API policies. We do not guarantee that any specific piece of data will always be available.
The Facebook integration relies on the Meta Graph API and the access levels Meta grants. If Meta changes API terms, restricts access, or revokes permissions, CCI features that depend on those APIs may be limited or unavailable without notice.
CCI software, design, and branding are owned by Fifth Element Agency Co., Ltd. or its licensors. You retain ownership of data you input into CCI. Public third-party content accessed via Meta APIs remains subject to the intellectual property rights of its original owners and to applicable Meta Platform Terms.
You are responsible for maintaining the confidentiality of your account credentials, for all activity under your account, and for ensuring your use of CCI and its integrations complies with applicable law.
To the fullest extent permitted by law, Fifth Element Agency Co., Ltd. will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of CCI Social Monitoring or its integrations.
We may suspend or terminate access to CCI Social Monitoring if you violate these terms, pose a security risk, or fail to pay applicable fees. You may terminate your account at any time through your account settings or by contacting support.
We may revise these terms periodically. Material changes will be communicated through the service or via email. Continued use after changes take effect constitutes acceptance of the revised terms.
These terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Disputes arising under these terms shall be resolved in the courts of Bangkok, Thailand.
